1. General
By booking with Rentable Recreation LLC ("Rentable Recreation," "we," "us," or "our"), you ("Customer," "Guest," or "Renter") agree to be bound by these Terms & Conditions in their entirety. These Terms constitute a legally binding agreement between you and Rentable Recreation LLC, a Texas limited liability company operating at Meadowmere Park, Grapevine Lake, Grapevine, Texas.
- •All bookings are subject to availability.
- •Payment is required to confirm a reservation.
- •All riders must meet age and safety requirements as outlined below.
- •Waivers must be signed prior to rental.
- •These Terms may be updated at any time. The version posted at the time of booking governs your rental.
2. Eligibility & Age Requirements
To operate a personal watercraft (PWC) rented from Rentable Recreation:
- •The primary renter must be at least 18 years of age and present a valid government-issued photo ID.
- •Operators born on or after September 1, 1993 must carry a valid Texas Boater Education Certificate or obtain an approved 15-day deferral prior to operating.
- •Minors may ride as passengers only and must be accompanied by a responsible adult at all times.
- •All operators must be physically and mentally capable of safely operating a PWC. Rentable Recreation reserves the right to refuse rental to any individual who appears impaired, unfit, or unable to safely operate equipment.
- •Rider switching is allowed at our location. Maximum group size, six people per jet ski rented. Everyone in the group must sign a waiver before participating.
3. Assumption of Risk
PLEASE READ THIS SECTION CAREFULLY. BY BOOKING AND PARTICIPATING IN ANY RENTAL, YOU ACKNOWLEDGE AND AGREE TO THE FOLLOWING:
Operating a personal watercraft involves inherent risks, including but not limited to: collision, capsizing, drowning, bodily injury, and death. These risks exist even when all safety precautions are followed.
By proceeding with your booking and rental, you voluntarily and knowingly assume all risks associated with the use of Rentable Recreation's equipment and waterway activities. You acknowledge that no amount of instruction, supervision, or safety equipment can eliminate all risk.
4. Release of Liability & Indemnification
To the fullest extent permitted by applicable law:
- •(a) Release: You hereby release, waive, discharge, and covenant not to sue Rentable Recreation LLC, its owners, employees, agents, and assigns (collectively "Released Parties") from any and all claims, damages, losses, costs, or expenses arising out of or relating to your use of rented equipment, whether caused by negligence of the Released Parties or otherwise.
- •(b) Indemnification: You agree to indemnify, defend, and hold harmless the Released Parties from and against any and all third-party claims, liabilities, damages, judgments, costs, and attorneys' fees arising from: (i) your use of rented equipment; (ii) your violation of these Terms; (iii) your violation of any applicable law or regulation; or (iv) any injury or damage caused by you or members of your party.
5. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY TEXAS LAW, RENTABLE RECREATION LLC'S TOTAL LIABILITY TO YOU FOR ANY CLAIM ARISING OUT OF OR RELATING TO THESE TERMS OR YOUR RENTAL SHALL NOT EXCEED THE TOTAL AMOUNT PAID BY YOU FOR THE RENTAL IN QUESTION. IN NO EVENT SHALL RENTABLE RECREATION BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES.
6. Safety Rules & Conduct
All guests must comply with the following rules at all times. Violation of any safety rule will result in immediate rental termination without refund and may result in further legal action:
- •No alcohol or drugs: Operating a PWC while impaired by alcohol or any controlled substance is strictly prohibited and is a violation of Texas law.
- •All guests must comply with Texas boating laws, Texas Parks & Wildlife regulations, and all applicable federal and state waterway rules.
- •Life jackets (PFDs) must be worn at all times while on the water. All equipment provided must be used as directed.
- •Reckless operation, excessive speed in no-wake zones, or harassment of other waterway users is prohibited.
- •All waivers must be completed prior to check-in and all guests must be present at check-in.
- •Renters are responsible for the conduct and safety of all members of their party.
7. Equipment & Damage Policy
- •Renters are responsible for any damage to equipment caused by misuse, negligence, or violation of these Terms.
- •Normal wear and tear is expected; damage beyond normal wear will be assessed and billed to the renter.
- •Lost or stolen equipment will be billed at full replacement cost.
- •Equipment must be returned to the designated area in the same condition as rented.
- •Any pre-existing damage must be reported to staff at check-in. Failure to report pre-existing damage may result in the renter being held liable.
8. Cancellation & Refund Policy
Host-Initiated Cancellations
- •If we cancel due to severe weather or unsafe conditions before the start time, you will receive a full refund.
- •If cancellation occurs during the rental, a prorated refund will be provided based on time remaining.
- •90% refund if canceled 48+ hours in advance (10% processing fee applies)
- •50% refund if canceled within 48 hours of start time
- •No refund for no-shows or cancellations after the start time
9. Required for Check-In
Failure to present any of the following at check-in may result in cancellation of your reservation without refund:
- •Valid government-issued photo ID (primary renter)
- •The credit card used to book (must match the ID name)
- •Completed rental agreement (submit online before arrival)
- •Completed waiver for every participant, including minors
- •Operators born on or after September 1, 1993: Boater Education Certificate or 15-day deferral
- •Your entire group must arrive at the rental booth at least 15 minutes before your start time -- check-in cannot begin until everyone is present
- •The main renter's ID will be held until all equipment is returned
10. SMS Communications
By providing your phone number and verbally consenting during a booking call, you agree to receive SMS messages from Rentable Recreation related to your reservation.
- •Message frequency varies. Message and data rates may apply.
- •Reply STOP to opt out at any time.
- •Reply HELP for assistance.
- •Rentable Recreation is not responsible for carrier delays or failures in SMS delivery.
- •By opting in, you confirm you are the account holder or have the account holder's permission. Your information will not be sold or shared with third parties for marketing purposes.
11. Privacy
Rentable Recreation collects personal information (including name, contact details, and payment information) solely for the purpose of processing bookings and communicating with you about your rental. We do not sell, rent, or share your personal information with third parties except as required to process payment or comply with applicable law.
12. Governing Law & Dispute Resolution
These Terms & Conditions shall be governed by and construed in accordance with the laws of the State of Texas, without regard to its conflict of law provisions.
Any dispute arising under or relating to these Terms that cannot be resolved informally shall be subject to binding arbitration in Tarrant County, Texas, under the rules of the American Arbitration Association. Each party shall bear its own costs unless the arbitrator awards otherwise.
Nothing in this section prevents Rentable Recreation from seeking injunctive or other equitable relief in a court of competent jurisdiction to protect its property or rights.
13. Severability
If any provision of these Terms is found to be unenforceable or invalid by a court of competent jurisdiction, that provision shall be modified to the minimum extent necessary to make it enforceable, and the remaining provisions shall continue in full force and effect.
14. Entire Agreement
These Terms & Conditions, together with any signed rental agreement and waiver, constitute the entire agreement between you and Rentable Recreation LLC with respect to your rental. They supersede all prior communications, representations, or agreements, whether written or oral.
15. Modifications to These Terms
Rentable Recreation reserves the right to modify these Terms at any time. Updated Terms will be posted on our website at www.rentablerecreation.com with a revised effective date. Your continued use of our services after any update constitutes your acceptance of the revised Terms.
